These Terms of Service are a legal agreement between you and Tempo governing your access to and use of the Tempo platform — including tempocreator.com, the Tempo DAW plugin, the Creator Fund, and all related services. By creating an account, subscribing, or using the Platform in any way, you agree to these Terms in full. If you do not agree, do not use the Platform.
Currently in Beta — these terms will take full effect upon public launch.
- You must be at least 18 years of age to use Tempo
- By creating an account you confirm you are 18 or older and have the legal capacity to enter into a binding agreement
- Tempo is currently available to residents of the United States and Canada only
- Canadian users acknowledge their use of the Platform is also subject to applicable Canadian federal and provincial laws, including PIPEDA and Quebec's Law 25
- Tempo reserves the right to deny access to any person or region at its sole discretion
- You must create an account on tempocreator.com to access the Platform. Account creation through the plugin is not permitted
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity that occurs under your account
- You may not share, sell, or transfer your account to another person
- You may only hold one active Tempo account at a time. Multiple accounts are a violation of these Terms
- Tempo reserves the right to suspend or terminate accounts at any time for any reason, with or without notice
- Access to the Tempo platform requires an active paid subscription at $9.99 USD per month
- Canadian users are billed in USD. Your bank or payment provider may apply a currency conversion fee — Tempo is not responsible for those fees
- Subscriptions are billed monthly on the date you first subscribed
- Payments are processed securely through Stripe. By subscribing you agree to Stripe's terms of service
- You authorize Tempo to charge your payment method on a recurring monthly basis until you cancel
- Tempo reserves the right to change subscription pricing with 30 days' notice. Price changes will not affect your current billing cycle
- You may cancel your subscription at any time through your account dashboard on tempocreator.com
- Cancellation takes effect at the end of your current billing period. You retain access until that date
- Tempo does not offer subscription pausing. Your options are active or cancelled
- After cancellation your account data, session history, and earned Units are retained for 90 days before permanent deletion
All sales are final. Tempo does not offer refunds under any circumstances.
This policy exists because a portion of every subscription payment is allocated directly to the Creator Fund upon receipt, compensating active creators for their verified work. Refunds would remove funds already distributed to or reserved for creators.
By subscribing you acknowledge and accept this no-refund policy.
- The Tempo plugin is proprietary software licensed to you for personal use only as part of your active subscription
- You may not reverse engineer, decompile, modify, distribute, or resell the plugin
- Your license to use the plugin terminates immediately upon cancellation or termination of your subscription
- Tempo may release updates at any time. Continued use constitutes acceptance of any updates
- The plugin is provided for use with digital audio workstations (DAWs) for music creation purposes only
Your participation in the Creator Fund is governed by the Tempo Creator Fund Terms, which are incorporated into these Terms by reference. By subscribing you agree to the Creator Fund Terms in full.
- Payouts are earned through verified active creation time — not guaranteed
- Payouts are issued on the 15th of each month for the prior month's activity
- Minimum payout threshold is $10.00 USD
- Tempo retains a 30% platform fee; 70% is distributed to eligible creators
- Abuse of the Fund will result in account termination and forfeiture of all earnings
You agree not to use the Platform to:
- Violate any applicable law or regulation
- Commit fraud or misrepresent your identity
- Attempt to manipulate or game the Creator Fund
- Interfere with or disrupt the Platform or its servers
- Upload malicious code, viruses, or harmful files
- Harass, threaten, or harm other users
- Use automated tools, bots, or scripts to interact with the Platform
- Attempt to access another user's account without authorization
- Use the Platform for any purpose other than music creation
You retain full ownership of all music, audio, and creative work you produce using Tempo. Tempo does not claim any rights, license, or ownership over your creative output.
- Proof Snippets are used solely to confirm active creation and are not stored commercially, licensed, or shared with third parties
- By submitting a Proof Snippet you represent that you own or have the right to submit that content
- You grant Tempo a limited, non-exclusive license to process and review Proof Snippets solely for verification purposes
The Tempo name, logo, website, plugin, and all related materials are the exclusive property of Tempo and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Tempo's trademarks, logos, or branding without prior written permission.
Tempo handles violations on a case by case basis. Depending on the nature and severity of the violation, Tempo may:
- Issue a warning
- Temporarily suspend your account
- Permanently terminate your account
- Forfeit your earned Units and pending payouts
- Report activity to relevant authorities where required by law
Tempo's decisions regarding violations are final. You may contact support@tempocreator.com to provide context.
- The Platform is provided "as is" and "as available" without warranties of any kind
- Tempo does not guarantee uninterrupted access to the Platform, the plugin, or the Creator Fund
- Tempo does not guarantee any specific payout amount or Fund balance
- Tempo is not responsible for losses resulting from technical failures, payment processing errors, or circumstances outside its control
To the maximum extent permitted by applicable law, Tempo's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to Tempo in the three (3) months preceding the claim.
Tempo is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data.
You agree to indemnify and hold harmless Tempo, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third party's rights.
Your use of the Platform is governed by the Tempo Privacy Policy, incorporated into these Terms by reference. By using the Platform you agree to the collection and use of your information as described in the Privacy Policy.
- By creating an account you provide express consent to receive transactional emails including receipts, payout notices, and account alerts
- Marketing emails are sent only with your express consent provided at account creation
- You may withdraw consent for marketing emails at any time via the unsubscribe link in any marketing email
- Tempo complies with Canada's Anti-Spam Legislation (CASL) and the US CAN-SPAM Act
- Unsubscribe requests are processed within 10 business days
- Withdrawing marketing consent does not affect your subscription or Platform access
Tempo may update these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
If you do not agree to updated Terms, you must cancel your subscription before the effective date.
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.
US Users
Disputes shall first be attempted to be resolved informally by contacting support@tempocreator.com. If informal resolution fails, disputes shall be resolved through binding arbitration in Michigan. You waive any right to participate in a class action lawsuit or class-wide arbitration against Tempo.
Canadian Users
Nothing in these Terms limits your rights under applicable Canadian federal or provincial law. Canadian users retain the right to file a complaint with the Office of the Privacy Commissioner of Canada (priv.gc.ca) regarding privacy matters. Quebec residents may also contact the Commission d'accès à l'information du Québec (cai.quebec.ca).
- You may terminate your account at any time by canceling your subscription and contacting support@tempocreator.com
- Tempo may terminate your account at any time for any reason, including violation of these Terms
- Upon termination all licenses granted to you immediately cease
- Sections 5, 9, 10, 13, 14, and 17 survive termination of these Terms
These Terms, together with the Creator Fund Terms and Privacy Policy, constitute the entire agreement between you and Tempo regarding the Platform and supersede all prior agreements or understandings.
